A party may lodge a binding non coverage declaration, together with an application fee of $2,500 determined by the Premier, with IPART seeking that a water industry infrastructure service be immune from coverage declaration.

Once IPART receives that application, IPART must recommend to the Premier on whether the declaration should or should not be made. Once the Premier receives the recommendation, the Premier may or may not make the binding non coverage declaration.
