Retailers cannot generally charge fees to customers when they change retail suppliers

From 1 January 2018 retailers have not been allowed to charge exit fees (also known as early termination charges) on most new and existing contracts with any electricity customer within NSW. However, there are some exemptions to the ban.

Energy retailers are still able to charge an early exit fee, where:

  • A solar system, a battery system, a digital meter, and any associated equipment, was installed as part of that contract and/or
  • The contract includes a fixed tariff or fixed charge for energy for the term of the contract.

We last reviewed early termination fees in 2013. Our decisions can be found in the documents on this page. After 2013, the Premier deferred further reviews.
